Terms of Service

These Terms of Service (the “Agreement”) are a legally binding agreement between you (“User”, “you”, “your”) and Jet Space Private Limited (“JetSpace”, “Company”, “we”, “us”, “our”).
This Agreement governs your access to and use of JetSpace.lk and all products and services offered by Jet Space Private Limited, including but not limited to web hosting services, server services, email hosting, and SSL certificate services (collectively, the “Services”).
By purchasing, accessing, or using any of the Services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and all policies incorporated herein by reference.

1. Additional Policies

Your use of the Services is also governed by the following policies, which are incorporated into this Agreement by reference:

• Acceptable Use Policy (AUP)
• Privacy Policy
• Backup Policy
• Infringement Policy

Additional terms may apply to specific Services (including but not limited to VPS, Dedicated Servers, Email Services, or SSL Certificates) and are incorporated by reference where applicable.

2. Account Eligibility and Responsibility

By registering for or using the Services, you represent and warrant that:

• You are at least eighteen (18) years of age;
• You are legally capable of entering into binding agreements;
• If you are using the Services on behalf of an entity, you are authorized to bind that entity to this Agreement;
• All information provided to JetSpace is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. JetSpace shall not be liable for any loss or damage resulting from unauthorized use of your account.

Providing false, misleading, or incomplete information may result in suspension or termination of Services without refund.

3. Scope of Services

JetSpace provides infrastructure and hosting-related services only. JetSpace does not sell, register, manage, or provide domain names.
Services may include:
- Shared Hosting
- Cloud Hosting
- VPS and Dedicated Servers
- Email Hosting
- SSL Certificates (provided as reseller products under JetSpace branding)
JetSpace reserves the right to modify, upgrade, suspend, or discontinue any Service at any time in its sole discretion.

4. User Content and Responsibility

You may upload, store, publish, and distribute content through the Services (“User Content”). You retain ownership of your User Content.
You represent and warrant that:
- You own or have lawful rights to all User Content;
- Your User Content does not violate applicable laws, third-party rights, or JetSpace policies.
JetSpace does not monitor User Content but reserves the right to remove, suspend, or disable access to any content or Service if it reasonably believes a violation of this Agreement or applicable law has occurred.
JetSpace shall not be liable for any loss of User Content.

5. Support, Security, and System Access

By submitting a support request or using the Services, you authorize JetSpace to access, modify, add, or remove files, data, configurations, or services within your account solely as necessary to:

• Provide technical support;
• Investigate or resolve issues;
• Detect, prevent, or remove malware or security threats;
• Enforce usage limits and policies;
• Maintain system stability and security;
• Comply with legal or regulatory obligations;

Such access shall be limited to what JetSpace reasonably considers necessary.

6. Payment, Billing, and Renewals

Prepayment

All Services are billed in advance. You agree to maintain valid billing information and pay all invoices on time.

Autorenewal

Unless cancelled prior to the renewal date, Services may renew automatically to prevent disruption.

Late or Non-Payment

Failure to pay invoices may result in suspension or termination of Services without notice. JetSpace reserves the right to delete data associated with suspended or terminated Services.

No Refunds on Renewals

All renewal payments are non-refundable, without exception.

7. Refund Policy
• No refunds on VPS, Dedicated Servers, SSL Certificates, or any renewal payments.
• A 30-day money-back guarantee applies only to Shared Hosting for first-time customers.
• Abuse, policy violations, or prior accounts void refund eligibility.
8. SSL Certificates (Reseller Products)

SSL Certificates are provided as reseller products sourced from third-party certificate authorities including Sectigo and RapidSSL.
JetSpace makes no warranties regarding SSL issuance timelines, browser trust behavior, or third-party CA actions. All SSL purchases are final and non-refundable once issued.

9. Limitation of Liability

IN NO EVENT SHALL JET SPACE Private Limited, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.
JETSPACE’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO JETSPACE FOR THE SERVICES DURING THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jet Space Private Limited and its representatives from any claims, damages, losses, liabilities, or expenses arising from:

• Your use of the Services;
• Your violation of this Agreement or any policy;
• Your User Content or activities.

This obligation survives termination.

11. Governing Law and Arbitration

This Agreement shall be governed by the laws of Sri Lanka.
Any dispute arising out of or relating to this Agreement shall be resolved by arbitration in Colombo, Sri Lanka.

12. Termination

JetSpace may suspend or terminate Services immediately and without refund if:

• You breach this Agreement or any policy;
• Your conduct poses legal, security, or operational risk;
• Required by law or authorities.

Upon termination, all User Content may be permanently deleted.

13. Changes to the Agreement

JetSpace reserves the right to modify this Agreement at any time. Continued use of the Services constitutes acceptance of the modified terms.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and Jet Space Private Limited regarding the Services and supersedes all prior agreements.
